1. Acceptance of terms

By creating an account or using Sandbrock Share (the “Service”), you agree to these Terms and our Privacy Policy. If you do not agree, do not use the Service.

Sandbrock Share is operated by SuperIC LLC (“we”, “us”, “our”). These Terms form a binding agreement between you and SuperIC LLC, and any reference to Sandbrock Share in these Terms means the Service operated by SuperIC LLC.

2. Eligibility and age requirement

You must be at least 18 years of age to create an account, list an item or service, or book a listing. You must be able to form a binding contract where you live and use the Service in good faith.

Sandbrock Share is intended for residents participating in the Sandbrock Ranch community. You agree to provide accurate identity and contact information and to keep it up to date.

3. Community conduct

You agree to treat other members with respect, provide accurate listing information, honor agreed pickup and return times, and follow applicable laws. Harassment, fraud, unsafe behavior, or violation of our Community Guidelines may result in listing removal, account suspension, or permanent ban.

4. Listings and bookings

Owners and providers are responsible for the condition, accuracy, and safety of their listings. Borrowers are responsible for care during the loan period and timely return in the same condition.

Sandbrock Share is a neutral marketplace and does not own, inspect, rent, or provide any listed items or services. All transactions are between members directly. We do not guarantee the quality, safety, legality, or accuracy of listings.

Most homeowner's insurance policies exclude personal items you lend or rent to someone else, often called the "voluntary parting" exclusion, so don't assume your own policy covers an item once it has left your hands. See our damage policy for how claims are handled and the current claim cap.

5. Services and credentials

When you offer a service, you agree to deliver what you describe, on time, to a reasonable standard. You represent that you hold any professional licenses, certifications, insurance, or authorizations required by law to perform the service in Texas.

All credentials, qualifications, and experience listed on your profile are self-reported. Sandbrock Share does not verify credentials and does not warrant that any service provider is qualified, licensed, or suitable for a particular job. Members are responsible for vetting service providers before booking.

Services that require state or federal licensure (including medical, legal, financial, childcare, and cosmetology services) may not be offered on the Service without the required credential. Listings that misrepresent credentials will be removed.

6. Vehicles and golf carts

Golf carts and similar low-speed vehicles operated on Sandbrock Ranch roads must comply with Texas law. Members who book, drive, or ride in a shared cart agree to the following:

Golf carts can operate on Sandbrock Ranch's community roads: Texas Transportation Code section 551.403(a)(1) and section 551.4031 allow golf cart operation inside a master-planned community like Sandbrock Ranch, unless a specific road is otherwise restricted by the city.

Drivers must hold a valid driver's license and be at least 17 years old (Tex. Att'y Gen. Op. KP-0364).

Carts stay on community roads posted 35 mph or slower, and drivers must not be under the influence of alcohol, drugs, or any impairing substance.

Every shared cart needs headlamps, taillamps, side reflectors, a working parking brake, and a rearview mirror in working order before each use (Transportation Code section 551.4041).

Texas doesn't require a golf cart operated this way to carry liability insurance (Transportation Code section 601.052(a)(2-a)); that's an exemption from the state mandate, not proof that a cart is covered.

Free neighbor-to-neighbor cart rides aren't a paid service, so they fall outside Texas Business & Commerce Code Chapter 113, the state's paid peer-to-peer car-sharing law; no statutory ride-sharing framework covers free rides.

Because Texas does not require liability insurance for a golf cart operated inside the community, Sandbrock Share fills that gap by contract instead: owners who list a golf cart represent that it is mechanically sound, insured, and street-legal where used, and borrowers should not assume a cart carries coverage beyond what its owner has confirmed. See Section 10 (Limitation of liability and insurance). Borrowers assume all risk associated with operation and agree to inspect the vehicle before use and report any defect to the owner.

Riders and drivers must accept the in-app ride waiver before every free ride, separate from the rental acknowledgment above. Because no Texas statute covers free rides between neighbors, that waiver, not Chapter 113, governs the risk members take on.

Neither Sandbrock Share nor the owner is responsible for traffic citations, towing, or damage resulting from borrower negligence, misuse, or violation of law. Borrower is liable for any loss, damage, or theft occurring during the rental period.

7. Prohibited items and services

The following may not be listed, requested, exchanged, or sold on Sandbrock Share:

Firearms, ammunition, explosives, or weapons of any kind.

Illegal drugs, controlled substances, cannabis products, or drug paraphernalia.

Alcohol and tobacco products.

Prescription medications or medical devices that require a license.

Stolen goods or items you do not have the legal right to share.

Counterfeit or infringing products.

Live animals, human remains, or biological materials.

Hazardous chemicals, flammable fuels, or regulated materials.

Adult sexual content or services.

Childcare without required state licensure; medical, legal, financial, or other licensed professional services without appropriate credentials.

Any item or service that violates federal, Texas, or local law.

Sandbrock Share may remove listings, suspend accounts, and report violations to law enforcement at our sole discretion.

8. Fees and payments

Sandbrock Share charges a platform service fee on paid transactions to cover operating costs, payment processing, and trust and safety. The fee schedule is 10% on items, golf carts, and paid bundle lines, 15% on services, deducted from the owner’s or provider’s payout rather than added to what a borrower pays. Every platform fee is waived while Sandbrock Share is in open beta. We will give notice before fees take effect.

Payments are processed by Stripe, Inc. Your payment card information is handled directly by Stripe under its terms and privacy policy; we do not store full card numbers. Owners and providers receive payouts to a linked bank account via Stripe Connect, subject to Stripe’s payout schedule and identity verification requirements.

You are responsible for any taxes resulting from your activity on the Service, including reporting income you receive as an owner or provider.

9. Cancellation and refunds

Borrowers may cancel a booking before the scheduled start time. Refunds are issued according to the cancellation policy shown on the listing at the time of booking. Platform service fees are non-refundable except where required by law.

Owners and providers who cancel a confirmed booking without a reasonable reason may be subject to penalties, including reduced visibility or account action.

Disputes over damage, late return, or service quality must be reported through the in-app dispute flow within 48 hours of the return handoff photo or session end. Sandbrock Share may, at its discretion, review evidence and issue partial or full refunds or hold deposits to resolve the dispute.

10. Limitation of liability and insurance

Sandbrock Share is a platform only. We do not provide insurance, property damage coverage, liability coverage, or any other form of insurance or guarantee on listings, transactions, items, services, vehicles, or members. Members use the Service at their own risk.

Owners and borrowers are responsible for their own insurance coverage for items, vehicles, and services exchanged on the Service. You are encouraged to verify your homeowner’s, renter’s, or auto insurance policy, including any riders or additional coverage needed for peer-to-peer rentals.

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

TO THE FULLEST EXTENT PERMITTED BY LAW, SANDBROCK SHARE, ITS OFFICERS, EMPLOYEES, AND AFFILIATES ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE SERVICE, ANY LISTING, OR ANY TRANSACTION BETWEEN MEMBERS.

Our total liability for any claim arising out of or related to the Service shall not exceed the greater of (a) the total fees you paid Sandbrock Share in the twelve months preceding the claim, or (b) one hundred U.S. dollars ($100). Nothing in these Terms limits liability that cannot be limited under applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Sandbrock Share, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

Your use of the Service or your listings;

Your violation of these Terms or any law;

Your violation of the rights of any third party, including other members;

Any transaction or interaction you have with another member, including damage, injury, or loss resulting from the use of a listed item or service.

12. Force majeure

Sandbrock Share is not liable for any delay or failure to perform resulting from causes outside our reasonable control, including acts of God, natural disasters, severe weather, fire, flood, pandemic, war, terrorism, civil unrest, government action, labor disputes, utility or internet outages, or failure of third-party service providers.

13. Governing law and disputes

These Terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws principles. You agree that any dispute, claim, or controversy arising out of or relating to these Terms or the Service shall be resolved exclusively in the state or federal courts located in Denton County, Texas, and you consent to personal jurisdiction and venue in those courts.

Notwithstanding the above, either party may bring an individual claim in a small claims court of competent jurisdiction in Denton County, Texas, for any dispute within that court’s jurisdictional limit.

14. Suspension and termination

You may close your account at any time from the Settings page. On account closure, we will cancel any pending bookings, release or return held funds in accordance with the cancellation policy, and retain transaction records as required for tax, legal, and security purposes (see our Privacy Policy).

We may, at our discretion and without prior notice, suspend or terminate your account, remove listings, or restrict your access to the Service if we believe, in good faith, that you have:

Violated these Terms, our Community Guidelines, or applicable law;

Engaged in fraud, misrepresentation, or abusive behavior toward other members or Sandbrock Share staff;

Created a safety risk to yourself, other members, or the community;

Chargebacked a transaction without first using the in-app dispute flow;

Abused refund, cancellation, or dispute policies;

Used the Service for any purpose other than its intended community purpose.

Suspension or termination does not relieve you of any payment, indemnification, or liability obligations incurred before the account action. Sections of these Terms that by their nature should survive termination (including Liability, Indemnification, Governing Law, and this Suspension & Termination section) will continue in full force.

15. Changes

We may update these Terms from time to time. Each version is stamped (see the version indicator at the top of this page). When we make material changes, we will prompt you to review and re-accept before your next use of the Service. Continued use after changes constitutes acceptance of the updated Terms.

16. Non-affiliation disclaimer

Sandbrock Share is an independent, neighbor-run project and is not affiliated with, endorsed by, or sponsored by Sandbrock Ranch, Hillwood Communities, or any homeowners association.The use of “Sandbrock” refers only to the geographic community where the Service operates. All trademarks belong to their respective owners.
